Only good examples are Rainbow Moon and CoE. The rest don't count.
There are no straight PS1 ports. The PS2 games are upgraded graphically and have additional features. RE4 is an HD Remaster of an HD Remaster, and RE5 and RE6 are HD Remasters.
I'm not saying it's not stupid in some cases, but if it was legitimately the exact same product that you bought for PS3, then you'd have a more convincing argument.
SMB3 and any other Virtual Console/WiiWare game are the exact same on Wii or Wii U or 3DS (and eventually NX) that you bought once already. No extra bells or whistles, no hraphical changes, no hand jobs from Miyamoto for your patronage. Same old (insert name of game).
Edit: Saying "play the game on what you originally bought it on" is very narrow sighted. Not every one may want to keep that console out and have it available to play, or may want to trade it in or sell it.
The other problem is Nintendo makes it hard for people to buy a new hardware iteration or replacement. System transfers are required.
If I lost my 3DS tomorrow, there is absolutely no way for me to ever redownload anything I bought without miraculously finding it. Take this poor kid for example: http://www.neogaf.com/forum/showthread.php?t=1256622
