The family members that were arrested for loitering on their own front lawn were charged, arrested, booked, and released one day; then, on the day they were released from jail, they were arrested AGAIN BY THE SAME OFFICER for loitering on their private property! The arresting officer is clearly ignorant, biased, malicious, and racist.
You can’t arrest people for doing the things they do in their daily lives in spaces where what they’re doing is appropriate. The history of loitering and vagrancy laws in the United States is very closely linked to racial regulation and oppression, and to the shoring up of Jim Crow laws in the South and the shoring up of racial segregation and hierarchy in the rest of the country as well.
In 2012, the township already struck down the unlawful and downright unconstitutional loitering ordinance.
The arresting officer should be fired and the family should be heavily compensated.
