Gary Oak counts as a greatest villain? I'm assuming that one was just to make the numbers seeing as he does nothing at all in the games to come across as a villain.

EDIT: And he beat LeChuck? So a guy that's at worst a friendly rival is a better villain than an undead pirate that killed a lot of people?

Right. Except the actor played a part of a person, and this is about the game character himself.

It has nothing to do with the games, it would be more like if a Red Dead Redemption comic came out and we voted John Marston as a better comic character than Batman.

Number of video games where Batman is a playable character - 39 excluding mobile phone games.

Number of video games where John Marston is a playable character - 1.

He may have been taken from comic books but the two Arkham games alone would make him a classic video game character. Those two games are inspired by the comics, but they are completely original stories in their own right.
