First things first, do we even know what the test failure was down to?
Isn't it entirely plausible that he was using pain killers? This guy puts his ass (and ironically his career) on the line week after week for our entertainment. His body has to be taking a severe amount of punishment.

Don't get me wrong, I'm a Hardy fan, but I'm neutral here. It could well be down to recreational drugs, but even so, I don't remember this uproar when Rob Van Dam was in a similar situation.

I'll wait till the facts have surfaced before I judge the guy.
