Breaking and Entering Assault charges.
this will be a short rant, but does anyone else think its fucking retarded if someone breaks into your home, they try to steal your tv or something and they trip on some wire or some shit they can sue you, i don't know about the other country's i know america and canada have this but its fucking retarded.
Imo i think if you enter someones house and trying to steal shit you should be allowed to kick the shit out of them, like really someone comes in and trys to steal personal belongings im not going be like oh sorry i don't want you to get hurt ill open the door for you thats just stupid, i think this needs to be changed. Let face facts the robberies are the ones trying to cause shit and if you hit them they can charge you for assault fuck get off my property then.
this rant isn't as personal towards anybody but just the fact people can charge you for fucking assault when they are causing shit makes me mad.

Re: Breaking and Entering Assault charges.
That's really fucked up, specially in Germany and Austria. By Law, if someone break into your House and you defend yourself, he can sue you for attacking him/her or whatever...And that's ridicolous IMO. From what I know, in the US you can even shoot that person, and in Europe you can't lay a hand on them? That should go into the "Self-Defense" part, because you are actually protecting yourself and your family.

It's not like it's against the law for the fact that someone hurts themselves in your house that they can sue you. People have to get an amazing lawyer to even consider, since America isn't that retarded yet.
also, look what I got in the mail today Steiner

Re: Breaking and Entering Assault charges.
lol that sounds like some weird law California has. Kentucky doesn't have anything like that. I love my state.
actually I don't believe even California would have something that stupid since tripping over something is not assault no matter what the case so I'm calling BS on this.

Re: Breaking and Entering Assault charges.
For the self defence part, it's usually on a case by case basis. You can, in the UK at least, defend yourself to a reasonable degree. If you throw some punches and subdue an intruder, you'll probably be able to claim self defence. If you go apeshit and beat the hell out of him, it would be unreasonable force. For instance if you took him to the ground, then put some kicks into him. At that point the threat is over - no need for more force - possibly ABH charges.
Also in the UK we have 'Occupiers Liability'. One part of it is you have to show a reasonable duty of care to trespassers on your property. So if there's any genuine dangers on your property, you have to make some degree of effort to make sure the danger is clearly marked or to remedy these dangers. I doubt that a loose wire would count as a danger though. A judge would laugh off a claimant sueing for tripping over a wire.
