Check out the pilot for my webshow WISHFUL THINKING. It is a show about a college student who fucks up his day and a Genie grants him the opportunity to do it all over again and he finds new and creative ways to fuck it up even more.
It's a difficult one if all he has done is throw and land one punch. Punches get thrown all the time outside pubs on Saturday night etc, sometimes the guys end up being charged with assault, but their sentence won't reflect that something like this could happen. So when something like this does happen, should the guy really be charged with manslaughter? Would it not be more accurate to be something in between manslaughter and accidental death? There's the causing death by carelessness charges, which might be appropriate, but I don't know what kind of sentences they receive. Being careless with your fists doesn't quite sound right either.
This would make a good topic for the TDL.
It's really sad though. I've heard of plenty of cases like it, not quite the same, but where one guy has killed another with a single punch, often when the receiver of the punch hits his head on the concrete after going down.
I think the prosecution would try for manslaughter though if they appeal against it they could try for a lesser charge. I doubt they would downgrade it though because it would set a precedent which would almost condone this sort of behavior. They need to make an example of these kind of people to make an absolute deterrent for this kind of behavior in the future.
I had a mate who punched someone outside a nightclub and he landed badly and died and he ended up getting 10 years with 7 to serve.
