Default Affirmative action

Fisher vs university of Texas is still going on in the Supreme court and the last time I checked the arguments were being heard. University of Texas was getting it's ass kicked and if the proceedings are any indication, the affirmative action law might be scrapped.
So think of this as maybe a farewell thread and post your thoughts on affirmative action, whether you liked it, disliked it, thought it served it's purpose or still needs to be there.

It was racist and not the way to go about what it hoped to do. Oh, we need to get 5 more black guys, so ignore all of those candidates over there that are more qualified, we don't have room for them and the blacks.

It gets worse now, it's not just race, but things like disabilities, military experience(even if unrelated), gender, and other things can give companies tax breaks just by keeping them around. So as long as they can do their job enough to not be fired, they get preferred over more qualified workers.

That's true. Also a big misconception is that people who are underqualified get hired which is far from the truth.

Thing is, people, a lot of people, don't hire the best person for the job, because they are biased and subsequently, pieces of shit. This law is there for preventing that injustice.
You won't believe how many times I have seen a retard get a good job just because, he knew the right people or because of his father. In theory, law sounds good.
University of Texas Fisher would not have gotten in regardless of the law, which means she isn't that good also.

And do the studies show if they were more qualified than males that applied for the jobs, or if the companies that hired the women did so because it was good for their image or for tax breaks?

Or are these just 'studies'?
