maybe its only canada, fuck its the most stupid law ive ever heard tho, my bad for thinking usa had it too, just the fact that this law is anyway is fucking dumb. some times people need to get a good ass kicking if your going to come into my house and hurt or steal something from me

Ok I'll educate you on US Common Law

There are three classifications of visitors on land:

Invitee (when inviting in the general public or someone for business dealings), Licensee (non public, invited person), and Trespasser (uninvited).

Invitee you have to warn of all hazards and check the premises for all hidden dangers(highest level of care).

Licensee - duty to warn relating to hazardous conditions

Trespasser - Duty to warn of only the most perilous conditions and to not willfully injure (like a trap door that shoots at trespassers when they open it).

However a lot of states, NY to be specific, have a duty of reasonable care to all people who enter one's property and eliminated the above mentioned classifications so it's more of a case by case basis.


FYI this is Civil law.

Generally criminal law common law says that a man's home is his castle so you can fuck someone up if they enter your castle. Same in NY, no duty to retreat when you're in your own home.

There was a report a few years ago where a guy broke into another guy's house, and the guy that was getting robed ended up picking up a samurai sword that he had and he chopped the thief to pieces. Got arrested after, but he kept saying it was self defense, even though the other guy didnt have any weapons with him.

So you're pro-capital punishment, essentially? And you could honestly live with yourself after murdering someone?

Obviously burglary is awful and despicable, but there are unquestionably far worse crimes. And you don't know the circumstances that could drive someone to do it, they're not all violent smackheads who just need something to sell for their next hit.

If it came down to me-or-them then I probably would at least try to kill someone in that situation, especially if I thought my wife or cats were at risk. But you have to remember that burglars don't break into houses with the intention to kill someone, they do it to steal stuff without being seen.

I just think it's very simplistic to say they should be killed.

I guess in a court of law I wouldn't exactly be pro-immediately-whack-off-thieves, but if someone cracked a window and broke into my house in the middle of the night I wouldn't hesitate to kill them for moral reasons.

Pro-capital punishment? Sort of, but probably not AS pro (or demented, sick, evil, nutty, or batshit) as I came off in that post. I wouldn't think twice about whether or not I'd have a rapist murderer or something killed. Thieves are really different story, but when I hear a story of a guy breaking through a woman's window holding a gun to her face and saying "get me your purse and all of you money'" while she's shivering in fear, I don't look at the guy as a human being anymore or anything above a complete piece of shit who's life is worthless.
